These Terms and Conditions ("Terms") govern your access to and use of ProofofUsefulness.com (the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
These Terms are between you and ArtMap Inc., doing business as HackerNoon ("HackerNoon," "we," "us," or "our"), a California corporation.
1Use of the Site
The Site provides reports, scores, evaluations, rankings, and other content generated from information submitted by users and/or publicly available sources. The Site is provided for informational and entertainment purposes only.
You agree to use the Site lawfully and not to misuse, disrupt, or interfere with its operation.
2User Submissions & Publication Rights
By submitting any information, content, data, links, or materials to the Site ("Submissions"), you represent that you have the right to submit such information.
You grant ArtMap Inc. d/b/a HackerNoon a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, analyze, publish, display, distribute, and create derivative works from your Submissions, including in public reports, rankings, marketing materials, and archives.
You acknowledge and agree that Submissions may be made public, in whole or in part, and that you have no expectation of confidentiality.
2.1 Right to Refuse or Remove
We reserve the right, but have no obligation, to refuse, remove, modify, or limit access to any Submission or Site content at any time, for any reason, in our sole discretion.
3Reports, Scores, and Defamation Disclaimer
All reports, scores, evaluations, rankings, and commentary generated by the Site:
- •Are opinions and/or algorithmic outputs, not statements of fact
- •Are based on user-submitted information, automated analysis, and subjective criteria
- •Are not guarantees of quality, performance, legality, or conduct
You agree that disagreement with or dissatisfaction about any score, report, ranking, or outcome does not constitute defamation.
To the maximum extent permitted by law, you waive and release ArtMap Inc. d/b/a HackerNoon, and its officers, directors, employees, contractors, and affiliates, from any claims related to defamation, libel, slander, reputational harm, or similar causes of action arising from Site content or outputs.
3.1 Public Interest and Anti-SLAPP
The Site's content relates to matters of public interest, technology, software, and digital work, and consists of protected opinion and commentary. Any claims targeting such content are subject to applicable anti-SLAPP protections under California law.
4No Duty to Verify
The Site does not independently verify the accuracy, completeness, or truthfulness of user submissions or third-party data. Errors, omissions, and outdated information may occur.
5Prizes, Rewards, and Contests
The Site may offer prizes, including cash payments, software credits, services, or other rewards.
All prizes:
- •Are offered at the sole discretion of ArtMap Inc. d/b/a HackerNoon
- •May be modified, substituted, delayed, or discontinued at any time
- •Are subject to additional rules, eligibility requirements, and terms, which may be posted separately or communicated directly
- •Are not guaranteed, and availability may depend on factors including quality, eligibility, timing, and internal review
All decisions regarding scoring, eligibility, selection, and prize distribution are final and binding, with no obligation to provide explanations or appeals.
6No Warranties; Limitation of Liability
The Site is provided "as is" and "as available", without warranties of any kind, express or implied.
To the maximum extent permitted by law, ArtMap Inc. d/b/a HackerNoon, its officers, directors, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, consequential, reputational, or punitive damages arising out of or related to your use of the Site, its content, reports, scores, or prize programs.
7Changes to These Terms
We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the updated Terms.
8Governing Law and Venue
These Terms, and any disputes arising out of or relating to them, are governed by the laws of the State of California, without regard to conflict-of-laws principles. You agree to submit to the exclusive jurisdiction and venue of the state and federal courts located in San Francisco County, California.
